Terms and Conditions of Sale (T&Cs) \u2013 version applicable as from its publication on the Site. Effective date: 1 August 2026. The website www.swigift.ch (the \u00abSite\u00bb) is operated by Swigift Varin<\/strong>, sole proprietorship registered in the commercial register of the Canton of Jura, Chemin de la Fenatte 12, 2824 Vicques (Val Terbi), Switzerland \u2013 UID: CHE-309.525.138 (hereinafter \u00abSwigift\u00bb). Contact: via the Contact page of the Site or using the contact details indicated in the Legal Notice.<\/em><\/p>

1. Definitions<\/h2>

Swigift<\/strong> : the company identified above, operating the www.swigift.ch platform and responsible for the marketing, distribution, issuance and administrative management of gift vouchers and partner offers.
User<\/strong> any natural person of full age and capable of discernment, or any legal entity, who accesses the Site or places an order thereon.
Beneficiary<\/strong> the person receiving a Gift Voucher, whether or not they are the buyer.
Partner<\/strong> : any business that has entered into a partnership with Swigift to market its services on the platform.
Gift Voucher<\/strong> digital or physical document generated by Swigift, featuring a unique code allowing the Beneficiary to obtain a service, experience or amount from the indicated Partner.
Order<\/strong> : any purchase request confirmed by the User on the Website.
Working days<\/strong> Monday to Friday, excluding official public holidays recognised at Swigift's head office.<\/p>

2. Purpose and scope<\/h2>

These T&Cs govern the contractual relationship between Swigift and Users for the sale of Gift Vouchers, experiences and offers proposed by Partners, as well as the associated services of the Site. Swigift acts exclusively as a distributor and commercial intermediary: the Partner remains solely responsible for the performance of the services. The relationship between Swigift and its Partners is governed by the General Terms and Conditions for Partners<\/strong>, a separate document available on the Website. In the event of any conflict between the Terms of Use and these Terms and Conditions, the Terms and Conditions shall prevail in all matters relating to Orders.<\/p>

3. Acceptance<\/h2>

Any validation of an Order implies full, complete and unreserved acceptance of these GCS, as well as, where applicable, the GCU and the Privacy Policy. The applicable GCS are those in force at the time the Order is validated. They prevail over any other conditions not expressly accepted in writing by Swigift.<\/p>

4. Access to the Website and order tracking<\/h2>

Access to the Site is free of charge; internet access costs remain the responsibility of the User. Ordering does not require the creation of an account: each Order receives a unique number communicated by email, which allows it to be tracked via the Site or with Swigift. The User guarantees the accuracy of the information they provide (identity, email, addresses). Swigift implements reasonable means to ensure the accessibility of the Site, without guaranteeing uninterrupted availability (maintenance, security, force majeure).<\/p>

5. Products and Services<\/h2>

Swigift sells monetary gift vouchers, services and experiences offered by independent Partners, as well as promotional or exclusive offers. Essential information for each offer (description, amount or value, specific conditions, validity period, Partner's identity) is presented on the Website prior to any Order. Photographs and visuals are provided for illustrative purposes only and are non-contractual.<\/p>

6. Creation and formats of the Gift Voucher<\/h2>

Following full confirmation of the payment, Swigift automatically generates the Gift Voucher, which notably includes the Partner's name, the service or amount, the period of validity, a unique identification code and the information necessary for its use. Depending on the User's choice, the Gift Voucher is sent by email (PDF), in a gift wallet or in a gift box. The physical formats may change without altering the nature or the value of the Gift Voucher.<\/p>

7. Customisation<\/h2>

Where this option is available, the User may personalise their Gift Voucher (message, card, photo). They remain solely responsible for the content submitted; once the Order has been confirmed, no changes can be guaranteed. Swigift reserves the right to refuse any content that contravenes Swiss law, or that is defamatory, abusive, discriminatory, violent, pornographic, infringes the rights of third parties, or is likely to damage its reputation or that of its Partners.<\/p>

8. Validity<\/h2>

The validity period \u2013 a minimum of twelve (12) months, unless otherwise stated \u2013 is indicated prior to the Order and is shown on the Gift Voucher. The Voucher becomes valid upon full confirmation of payment and expires on its expiry date; any request for an extension is at the discretion of the Partner concerned. The termination of the partnership between Swigift and a Partner does not affect the validity of Vouchers sold prior to the effective date of termination: the Partner remains obliged to honour them until their expiry date, under the terms and conditions in force at the time of their issue.<\/p>

9. Utilisation, balance and transmission<\/h2>

The Gift Voucher can only be used with the specified Partner, in accordance with their terms and conditions (booking, opening hours, availability, specific conditions). The Partner may check the authenticity of the unique code prior to providing any service.
Part payment<\/strong> when the value of the Voucher exceeds the price of the chosen service, the remaining balance can still be used with the same Partner until the Voucher expiry date; it is neither refunded nor exchanged for cash.
Transmission<\/strong> : The Gift Voucher may be freely transferred at no cost; the person presenting the code is deemed to be authorised to use it.
Cumulative total<\/strong> unless stated otherwise, the Voucher cannot be used in conjunction with other promotions or benefits.<\/p>

10. Lost voucher, fraud<\/h2>

User loss<\/strong> As long as the Voucher is valid and unused, Swigift can re-issue the document (PDF) upon request, subject to proof of purchase (order number, email). Fraud<\/strong> : Any voucher that has been forged, altered, reproduced, used fraudulently or whose code appears to have already been used may be refused by the Partner or by Swigift. In the event of any doubt as to its authenticity, its use may be suspended whilst checks are carried out. No compensation is payable where fraud is detected.<\/p>

11. Prices and taxes<\/h2>

All prices are quoted in Swiss francs (CHF), inclusive of tax where applicable. Gift Vouchers with a monetary value are means of payment at face value: VAT relating to the service is payable by the Partner when the Voucher is used, in accordance with applicable legislation. The applicable prices are those displayed at the time the Order is confirmed; price changes do not affect Orders that have already been confirmed. In the event of a clear pricing error, Swigift may cancel the Order in question after informing the User and refund any sums received.<\/p>

12. Value, costs and final price<\/h2>

The User chooses the amount from the proposed values or, if the option is available, freely sets the amount within the displayed limits (minimum amount indicated on the Site). Depending on the delivery option: digital delivery free of charge unless otherwise indicated; gift pouch and box with preparation and shipping fees indicated when placing the Order. Before confirmation, a summary shows the value of the Voucher, any applicable fees, the selected options and the total amount; confirmation constitutes acceptance of the final price.<\/p>

13. Payment<\/h2>

Payment is due immediately upon validation of the Order; no Voucher is issued until payment is fully confirmed. The available payment methods are those offered on the Site (in particular bank card and TWINT, via our secure payment service provider). Payments are processed by specialised providers in accordance with industry security standards; Swigift does not store bank details. In the event of authorisation refusal, the Order is cancelled. Swigift may suspend or refuse any Order in the event of a payment incident, suspected fraud, prior dispute or abusive chargeback.<\/p>

14. Order validation<\/h2>

Swigift sends an order confirmation by email. The data recorded by Swigift and by the payment service providers shall constitute proof until proven otherwise.<\/p>

Delivery<\/h2>

Digital<\/strong> the Voucher (PDF) is sent by email upon completion of the Order, to the User or, at the User's discretion, directly to the Beneficiary at the email address provided under the sole responsibility of the User. Swigift shall not be held liable for non-receipt due to an incorrect address, spam filtering or a messaging malfunction beyond its control.
Physique<\/strong> Vouchers are dispatched to the address provided during the Order; dispatches are limited to Switzerland, unless otherwise indicated.
Deadlines<\/strong> ; routing is handled by the postal services. No refund is due in the event of a mere delay, barring mandatory legal provisions.
Loss or damage by the carrier<\/strong> the risks pass to the recipient upon handover to the carrier, subject to statutory provisions. Swigift will assist the User in finding a solution (in particular the re-issuance of the Voucher if the code has not been used), with no guarantee of replacement when the code can no longer be secured.<\/p>

16. Cancellation, refund, no right of withdrawal<\/h2>

Swiss law does not provide for a general right of withdrawal for online purchases; Articles 40a et seq. of the Code of Obligations do not apply to e-commerce. Gift Vouchers, which are individually generated and immediately usable, are consequently neither refundable nor exchangeable after their issuance, barring any mandatory statutory provisions to the contrary. Cancellation remains possible as long as the Voucher has not been generated and no irreversible processing has been carried out. Exceptional refunds remain at the sole discretion of Swigift.
Cessation of trading of a Partner<\/strong> the Gift Voucher constitutes a claim against the Partner, who remains solely liable and solely responsible for the service. In the event of insolvency or cessation of business of the Partner, Swigift \u2013 a mere intermediary \u2013 does not guarantee the performance of the service.<\/p>

17. Responsibilities<\/h2>

Swigift operates a marketing, issuing and distribution platform for Gift Vouchers: unless expressly stated otherwise, it acts solely as an intermediary and is not the provider of the services, which fall under the sole responsibility of the Partners (performance, compliance, availability, information transmitted, compliance with the law). Swigift does not guarantee either the availability or the performance of the Partners' services. Within the limits of Swiss law, Swigift shall not be liable for indirect damages, loss of business, profits or data, delays attributable to third parties, temporary unavailability of the Website or non-performance attributable to a Partner; its liability is limited to direct damages resulting from a fault attributable to it. Liability for intent or gross negligence as well as any mandatory liability under law (Art. 100 para. 1 CO) remains reserved.<\/strong><\/p>

18. Complaints<\/h2>

Any complaint must be sent to Swigift within a reasonable timeframe from the discovery of the issue, along with the order number, supporting documents and a precise description. When the complaint relates to a Partner's service, Swigift may forward the necessary information to them; it does not replace the Partner in handling the matter.<\/p>

19. Force majeure<\/h2>

Swigift shall not be held liable when an event beyond its control totally or partially prevents the performance of its obligations (in particular natural disasters, fires, pandemics, wars, acts of authorities, strikes, network interruptions, major cyberattacks, unavailability of payment or transport service providers). The obligations concerned shall be suspended for the duration of the event.<\/p>

20. Intellectual property<\/h2>

The entire Site (software, text, photographs, graphics, logos, Gift Voucher templates, designs, trademarks, databases) remains the exclusive property of Swigift or the rights holders. Any reproduction, representation, adaptation, extraction or distribution, in whole or in part, without prior written authorisation is prohibited. Partner trademarks and content remain their exclusive property.<\/p>

21. Data protection<\/h2>

Swigift processes personal data in accordance with Swiss law (revFADP). The methods of collection, processing, retention and security, as well as the rights of data subjects, are detailed in the Privacy Policy available on the Website.<\/p>

22. Amendment of Terms and Conditions<\/h2>

Swigift may modify these T&Cs at any time; the new provisions shall apply as soon as they are published on the Site. Orders already confirmed shall remain governed by the version in force on the date of their confirmation.<\/p>

23. Severalty clause<\/h2>

If any provision of these T&Cs is declared null or inapplicable, the others shall remain in force; the provision in question shall be replaced by a valid provision that comes as close as possible to the intended objective.<\/p>

24. Applicable law and jurisdiction<\/h2>

These Terms and Conditions are governed exclusively by Swiss law. The place of jurisdiction is Porrentruy (Jura)., subject to the mandatory jurisdictions provided for by law, in particular regarding consumers (Articles 32 and 35 of the Swiss Civil Procedure Code)<\/strong>.
